Negligence 失職，疏忽

Negligence of duty就是“玩忽職守”。

The accident was caused by negligence onthe part of the driver.

事故是由于司機的過失造成的。

Not Guilty 無罪

He was found not guilty, by reason ofinsanity.

他以精神失常為理由獲判無罪。

“無罪”的另一個說法是acquittal，二者的區別是，not guilty是形容詞形式，陪審團宣布被告“無罪”，而acquittal是名詞形式，是正式的“無罪判決”。

The jury voted 8-to-4 in favor ofacquittal.

Objection 反對

Verdict 裁決

Verdict（裁決）多指刑事案件中由陪審團做出的“有罪”(guilty)或“無罪”(not guilty)判定；

Sentence（刑罰判決）則是在達成有罪的裁決后對被告做出的具體懲罰，比如，imprisonment（監禁）、fine（罰款）等，這個刑罰的決定是由法官或者法庭工作人員決定的。

Judgment（判決）（在刑事案件中）則包括verdict（裁決）和隨之而來的sentence（判決）兩部分（A judgment constitutes the final decision of the court and includesthe verdict and the sentence imposed）。

民事案件一般遵循不告不理的原則，即當事人不主動向國家司法機關請求，國家司法機關一般不介入干預當事人之間的糾紛。而刑事案件一般都有國家刑事司法機關主動介入，受害人或者群眾報案、舉報后，公安、檢察機關即會介入偵查。然后由檢察院代表國家對被告人提起公訴，由法院作為法律的裁判者進行公正的審判從而達到制裁犯罪人和保護人民的刑法目的。

上訴案件通常有兩種結果：維持原判(maintain the originaljudgment)，或者推翻原判(reverse the original judgment)，另外還有一種可能是退回一審法院進行補充審理（send the case back to the trial court for additional proceedings）。
